I've had the pleasure of working with Mr. Hanchey on two occasions, and each interaction has been nothing short of exceptional. His professional demeanor, coupled with the outstanding support from his staff significantly alleviated any anxieties I had. I am thoroughly satisfied with the outcomes achieved. Should the need for legal representation arise in the future, Mr. Hanchey will undoubtedly be my first choice.

      Lucas Garcia

Mark Hanchey has been excellent. I spoke with him last minute before my court date. He still showed up to court with me and was very caring and helped me before I had even officially hired him. I felt like he cared about me and my case. He knows his craft very well and you can tell that the judge and other attorneys respect him when he is in court. He is also very kind. I recommend him to anyone. An excellent attorney.

      Renee Braucht

I had an amazing experience with the Hanchey Law Firm! Mr. Hanchey got me the absolute best result I could have imagined for my case. I can’t even tell you how many times I’ve heard, “wow, you must have had a really good lawyer!” when discussing the result. I live far from Colorado Springs, but I will forever make the trip for this firm when I need them! Highly recommend!

      David Walker

I have needed to use a lawyer a couple of times over the past several years and have used Mark Hanchey. He is a very down to earth person who has always treated me with dignity and has always been straight forward. His staff has also been professional and friendly. Each time I used Mark Hanchey the result was a positive one. I also think his fees are reasonable. I cant say enough good about Mark Hanchey.

      Colorado Springs Military Defense Lawyers

Facing criminal charges while serving in the military can be a daunting experience, leaving individuals feeling uncertain about their future. If you find yourself on this page, it’s likely that you’re seeking guidance and legal representation for a military-related offense in Colorado Springs, Colorado. Here at The Law Firm of Mark S. Hanchey and Ben Peterson, we understand the gravity of your situation and are here to provide the support and advocacy you need during this challenging time.

      Understanding Military Criminal Charges

When it comes to military criminal offenses, the Uniform Code of Military Justice (UCMJ) serves as the governing authority. The UCMJ delineates various offenses, ranging from relatively minor infractions to serious felonies, under its “Punitive Articles.” These offenses encompass a wide array of behaviors and actions that can result in disciplinary action by military authorities.

      Federal Convictions and Legal Ramifications

It’s crucial to recognize that being convicted of a military offense carries significant legal consequences. Since the UCMJ is established by Congress, any conviction resulting from a court-martial constitutes a federal conviction. Depending on the severity of the offense and the type of court-martial proceedings, a conviction can result in either a federal felony or misdemeanor charge.

      Navigating the Legal Process

When facing military criminal charges, having experienced legal representation is essential. At The Law Firm of Mark S. Hanchey and Ben Peterson, we focus on military defense law and are well-versed in the intricacies of the UCMJ. Our team of dedicated Colorado Springs Military Defense Lawyers are committed to helping you understand your rights, navigate the legal process, and pursue the best possible outcome for your case.

Types of Military Offenses We Handle

As a former JAG attorney, Mr. Hanchey has always maintained a special interest and desire to help soldiers, airmen, and their dependents. There are many special concerns that arise in the field of criminal defense when the person charged with the crime is on Active Duty in the United States Military. Our firm handles a wide range of military criminal offenses, including but not limited to:

      DUI

The same concerns surround charges of DUI (Driving Under the Influence), DWAI (Driving While Ability Impaired) and DUID (Driving Under the Influence of Drugs). The Law Firm of Mark S. Hanchey and Ben Peterson is very committed to providing the most effective defense that not only minimizes the damage that these types of charges may have on your driving record, but on your military career as well.

      Positive UAs

Positive urinalysis results for drugs can lead to disciplinary action and legal proceedings.

      Officer Misconduct

Allegations of misconduct among military officers require experienced legal representation to protect your rights and reputation.

      Assault Charges

Accusations of assault within the military can have far-reaching implications for your career and personal life.

      Extramarital Sexual Conduct (Adultery)

Charges related to extramarital affairs can result in severe consequences under military law.

      Domestic Violence

In the area of domestic violence, even a conviction for a very low level misdemeanor will result in the involuntary separation of the service member due to Federal Legislation involving weapon possession. The Brady Bill and its attached Lautenberg Amendment precludes anyone who has been convicted of a domestic violence offense from possessing a weapon. The same is true for anyone about whom a Permanent Restraining Order has been issued in a domestic violence setting. Thus, even relatively non-serious offenses such as harassment, obstruction of a telephone, and criminal mischief (all misdemeanors) will result in the Separation of an Active Duty Soldier. Separation of the Service member can also result even if the conviction is otherwise entered pursuant to a Deferred Judgment and Sentence.

      Child Pornography Charges

Charges related to child pornography are taken very seriously by military authorities and require immediate legal intervention.

      Rape Accusations

Being accused of rape or sexual assault can have devastating consequences, making it crucial to have a strong defense strategy in place.

      Larceny

Charges related to theft or larceny can result in significant penalties, including imprisonment and dishonorable discharge.

      Murder

Accusations of murder or manslaughter demand vigorous legal defense to protect your rights and freedom.

War Crimes and National Security Cases

Allegations of war crimes or breaches of national security require a strategic and comprehensive legal approach.

      Computer Crimes

Charges related to computer crimes, such as hacking or unauthorized access, necessitate legal representation to navigate complex technical and legal issues.

      Felonies and other Misdemeanors

Any Felony conviction also carries with it the loss of one’s ability to carry or possess a firearm. This is due to Federal legislation found at 18 U.S.C. 922(G), a 1993 Federal Statute commonly referred to as the Brady Bill. Even if you, as a military service member, resolve a felony by virtue of a deferred judgment and sentence, you may well be precluded from possessing a weapon during the deferred sentence. For these reasons, it is very important that an active duty soldier speak with our experienced Colorado Springs Military Defense Lawyers who understand the collateral effects that his or her criminal case may have on their military career.

The Law Firm of Mark S. Hanchey and Ben Peterson also assist people with legal needs in the following areas: Black Forest, Castle Rock, Centennial, Cimarron Hills, Douglas County, El Paso County, Fountain, Highlands Ranch, Parker, and Pueblo County.
